A personal injury occurs when a person has suffered some form of injury, either physical or psychological, as the result of an accident.
The most common type of personal injury claims are auto accidents and accidents at work. Indeed, there are a multitude of types of accidents and the term personal injury also incorporates medical and dental accidents (which lead to numerous medical and dental negligence claims every year) and conditions which are often classified as industrial disease cases. Where the accident was not the individual’s fault, the injured person may be entitled to compensation. If you have been involved in an auto accident, and any damage has occurred, then you should have the police complete an accident report. If you have suffered an injury, you should seek medical treatment. If the other driver is at fault, his or her insurance company may be liable to you for the damages to your automobile, your medical bills, pain and suffering and any other damages you may have suffered. If your medical bills are paid by your health insurance carrier, and/or your auto insurance carrier, then they may have what is called subrogation rights. This means that they may be entitled to be paid back all, or a portion, of what they paid toward your bills from any settlement you may receive from the negligent driver.
